1.About these terms

These terms apply when you use the RootLingua app and the website rootlingua.com (together, “RootLingua”). RootLingua is provided by Rootlingo AS, org. no. 835 168 212, Lysaker brygge 32, 1366 Lysaker, Norway (“we”, “us”).

By creating an account or using RootLingua, you accept these terms. If you do not accept them, please do not use RootLingua.

2.Who can use RootLingua

You must be at least 13 years old to create an account. If you are under 18, a parent or guardian must accept these terms on your behalf and is responsible for your use of RootLingua, including any purchases.

3.Your account

Give us accurate information and keep your login details to yourself. You are responsible for what happens on your account. If you think someone else has access to it, contact us straight away. You can delete your account at any time.

4.Free use and Premium

RootLingua is free to use with ads. The free version gives you a limited number of seeds each day, which you can refill by watching an ad.

Premium is a paid subscription that gives you unlimited seeds. The price, including any VAT, is shown before you buy. Subscriptions renew automatically for the same period until you cancel. You can cancel at any time, and the cancellation takes effect at the end of the period you have already paid for.

If you buy Premium through the App Store or Google Play, their terms also apply to payment, cancellation and refunds, and you manage your subscription there. If we change the price, we will tell you in advance, and you can cancel before the new price applies.

5.Right of withdrawal

If you are a consumer in the EU/EEA, you normally have 14 days to withdraw from a purchase. Premium gives you access to digital content immediately. When you buy, you will be asked to agree that access starts right away and that you thereby lose your right of withdrawal. This does not affect any other rights you have under consumer law.

6.Using RootLingua fairly

You may not:

• copy, sell or publish content from RootLingua without our permission;
• collect content or data from RootLingua with automated tools;
• try to get around seed limits, ads or payments, or access parts of RootLingua you are not meant to;
• reverse engineer the app, except where the law allows it;
• use RootLingua to break the law or to harm, harass or mislead others.

7.Our content

All content in RootLingua, including lessons, flashcards, stories, illustrations, audio, software, and the RootLingua name and logo, belongs to Rootlingo AS or our licensors and is protected by copyright and other laws. We give you a personal, non-transferable right to use RootLingua for your own learning. This right ends if your account is closed.

8.Ads and links

The free version shows ads from third parties. Ads and links may take you to products or websites that we do not control, and we are not responsible for them.

9.Availability and accuracy

We work to keep RootLingua available and to improve it, and we may add, change or remove features. We cannot promise that it will always be available or free of errors.

We take care with our language content, but translations and pronunciations can contain mistakes. RootLingua is a learning tool and should not be relied on for professional, legal or medical translation.

10.Liability

As far as the law allows, we are not liable for indirect losses, such as lost profits or lost data. Nothing in these terms limits liability that cannot be limited by law, including liability for gross negligence or intent, or your mandatory rights as a consumer.

11.Suspension and termination

You can stop using RootLingua and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms. If we close a paid account for any other reason, we will refund the part of the subscription you have not used.

How we collect and use personal data is described in the privacy notice below.

13.Changes to these terms

We may update these terms, for example when we add new features or the law changes. If a change is significant, we will tell you in the app or by email before it takes effect. If you do not accept the new terms, you can delete your account before they apply.

14.Law and disputes

These terms are governed by Norwegian law. If you have a complaint, please contact us first. We want to put things right. If we cannot agree, consumers can get help from the Norwegian Consumer Council (Forbrukerrådet), and consumers in other EU/EEA countries can contact their national European Consumer Centre. Disputes are decided by the Norwegian courts, unless mandatory consumer law gives you the right to bring a case where you live.

These terms are available in several languages. If the versions differ, the English version applies.

2.What data we collect

• Account details: your email address and login details.
• Language settings: the language you speak and the languages you are learning.
• Learning progress: the words and stories you have studied, your answers in games, and your seed balance.
• Purchase information: whether you have Premium and when it renews. Payments are handled by the App Store or Google Play, and we never see your card details.
• Device and technical data: device type, operating system, app version, IP address and error reports.
• Advertising data: in the free version, our advertising partner receives your device’s advertising identifier and IP address to show and measure ads.
• Messages: what you write when you contact us.

3.How we collect your data

You give us most of this data directly when you create an account, use the app, buy Premium or contact us. The app collects device and technical data automatically while you use it. We receive your purchase status from the App Store or Google Play.

4.How we use your data

We use your data only for the purposes below. Each purpose has a legal basis under the GDPR, shown in brackets.

• To create and run your account, save your progress, and give you Premium if you pay for it (our contract with you).
• To keep RootLingua secure, prevent misuse and fix errors (our legitimate interest in a safe, working service).
• To see, in combined form, which lessons and words learners find hard, so we can improve our content (our legitimate interest in improving RootLingua).
• To show ads in the free version. Ads are personalised only if you have given your consent, and you can withdraw it at any time in the app’s settings (your consent).
• To answer your messages (our legitimate interest) and to keep the accounting records the law requires (legal obligation).

We do not make automated decisions about you that have legal or similarly significant effects.

5.Who we share your data with

We do not sell your personal data. We share it only with:

• Google (Firebase), which hosts our app data, website and media files for us;
• our advertising partner, in the free version;
• Apple and Google, when you buy Premium through their app stores;
• public authorities, when the law requires us to.

Google processes our app data only on our instructions and under a data processing agreement. Our advertising partner and the app stores handle your data under their own privacy policies.

6.How we store your data

Your data is stored on the Google Cloud servers that Firebase uses, protected by encryption in transit and by access controls. Some of our providers process data outside the EU/EEA, including in the USA. When they do, the transfer is protected by the EU Standard Contractual Clauses or the EU-US Data Privacy Framework.

We keep your data for as long as you have an account. When you delete your account, we delete your personal data within 30 days. Records we need for accounting are kept for as long as Norwegian bookkeeping law requires.

7.Marketing

We send you news and offers by email only if you have agreed to receive them. You can unsubscribe at any time with the link in every email or by contacting us.

8.Your data protection rights

Under the GDPR, you have the right to:

• see the personal data we hold about you and get a copy of it;
• have wrong or incomplete data corrected;
• have your data deleted, in certain circumstances;
• limit how we use your data, in certain circumstances;
• object to us using your data on the basis of our legitimate interests;
• receive your data in a machine-readable format, or have it sent to another service;
• withdraw your consent at any time. This does not affect what we did with your data before you withdrew it.

9.Cookies and similar technologies

The rootlingua.com website does not use cookies for tracking or advertising. It saves the language you choose in your browser’s local storage, so the next page opens in the same language. The website loads fonts, images and audio from Google’s servers, which means your browser shares your IP address with Google when you visit.

In the free version of the app, your device’s advertising identifier is used to show ads. You can reset or limit this identifier in your device’s settings.

10.Children

RootLingua is not meant for children under 13, and we do not knowingly collect their data. If we learn that we have, we delete it.

11.Other websites

RootLingua contains links to other websites, including through ads. This privacy notice covers only RootLingua, so please read the privacy policy of any other website you visit.

12.Changes to this privacy notice

We review this privacy notice regularly and publish any changes on this page. If a change is significant, we tell you in the app or by email.
